By creating an account or using One Deep ("the App"), you agree to these Terms. If you do not agree, do not use the App. We may update these Terms at any time; continued use constitutes acceptance.
You must be at least 21 years of age to use this App. By creating an account, you confirm under penalty of perjury that you are 21 or older. We reserve the right to request proof of age and to terminate accounts of users who misrepresent their age.
One Deep is an entertainment-only social party game application. The App generates challenges, dares, and prompts ("Quests") for entertainment purposes. The App does not sell, serve, distribute, or provide alcohol. Any references to drinking within Quests are suggestions for entertainment and are entirely optional. You are never required to consume alcohol to use the App.
BY USING THIS APP, YOU ACKNOWLEDGE AND AGREE THAT:
(a) You are solely responsible for your own actions, including but not limited to: alcohol consumption, physical activities, social interactions, and any challenges you choose to participate in.
(b) Participation in any Quest is entirely voluntary. You may skip, decline, or modify any Quest at any time without penalty beyond in-app game points.
(c) The Company, its owners, officers, employees, and affiliates shall not be held liable for any injuries, damages, losses, legal issues, medical emergencies, or consequences of any kind arising from your use of the App or participation in Quests.
(d) You assume all risks associated with physical activities, social interactions with strangers, alcohol consumption, and any other activities undertaken in connection with the App.
(e) You agree to drink responsibly and to comply with all applicable laws regarding alcohol consumption in your jurisdiction.
(f) You will not operate a motor vehicle or heavy machinery while impaired or after consuming alcohol during use of the App.
The Company has no obligation to monitor, supervise, or enforce the behavior of users. We do not control whether users consume alcohol, how much they consume, or how they interact with others. The App is a digital entertainment product only.
Some Quests may be generated using artificial intelligence. AI-generated content is provided as-is for entertainment. The Company does not guarantee that AI-generated Quests are appropriate for all contexts or audiences. You are responsible for exercising your own judgment about which Quests to participate in.
Users may post text, photos, and other content ("User Content"). You retain ownership of your content but grant us a worldwide, non-exclusive, royalty-free license to display it within the App. You agree not to post content that is illegal, defamatory, harassing, threatening, sexually explicit involving minors, or violates any third party's rights. We may remove content at our discretion.
We may suspend or terminate your account at any time for violation of these Terms or for any reason at our sole discretion. You may delete your account at any time through Settings.
You agree to indemnify, defend, and hold harmless the Company and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the App, your violation of these Terms, or your violation of any law or rights of a third party.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS (IF ANY).
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
These Terms shall be governed by the laws of the Commonwealth of Virginia, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Virginia.
